Defense Base Act Contractors from India: You have Important Rights

India has many HVAC mechanics, engineers, and other construction workers employed by American companies under the U.S. Department of Defense’s Base Act. Many of these workers are recruited in their home country by American contractors who bring them to work on U.S. military bases worldwide.
The Base Act provides these workers with certain rights, including the right to workers’ compensation if they are injured on the job.

Right to Workers Compensation Benefits
This Base Act provides workers’ compensation benefits to Indian HVAC workers who are injured or contract an illness while working on a U.S. military base.
Benefits under the Base Act can include:
- Medical expenses:The Base Act pays for all reasonable and necessary medical expenses related to your injury or illness, including hospitalization, surgery, and prescription medication.
- Wage replacement:If you cannot work because of your injury or illness, the Base Act provides wage replacement benefits that can replace a portion of your lost income.
- Death benefits:If you are killed while working on a U.S. military base, the Base Act provides death benefits to your surviving spouse and dependent children.
These are just some of the benefits that may be available to you under the Base Act. Other eligible benefits may include vocational rehabilitation and benefits for permanent disability.
To receive these benefits, you must first file a claim with the Department of Labor’s Office of Workers’ Compensation Programs (OWCP). The OWCP will then review your claim and make a determination as to whether or not you are eligible for benefits.
